Effective for Mother Choice App (B2B FMCG)

1. Introduction

The Mother Choice App ("the App") is a platform provided by VENKATA SAI LAKSHMI ENTERPRISES ("we," "us," or "our") for business-to-business (B2B) transactions involving fast-moving consumer goods (FMCG). By accessing or using the App, the user ("User" or "you") agrees to these Terms and Conditions.

2. User Accounts and Eligibility

• Registration: To use the App, registration is required, along with accurate and complete business information, and other required documents.
• Business Use Only: The App is for B2B transactions only and not for personal use.
• Account Security: Users are responsible for maintaining the confidentiality of their account details and password and for all activities under their account.
• Account Termination/Suspension: We reserve the right to suspend or terminate a user's account if these terms are violated or if a breach of security is suspected.

3. Product and Order Information

• Product Information: Product descriptions, prices, and availability are subject to change without prior notice.
• Order Acceptance: Orders placed on the App are offers to purchase products from sellers.
• Order Cancellation: Orders may be canceled at the discretion of the seller or the company due to limited quantities, pricing errors, or other reasons.
• Delivery: Delivery is subject to availability and location. Users are responsible for providing necessary equipment and labor for delivery.
• Returns and Refunds: The Returns and Refund Policy (as detailed separately) governs returns and refunds. Returns may not be accepted for certain product types due to hygiene reasons.

4. Payment Terms

• Pricing: Product prices are subject to change.
• Payment Methods: Maximum all payment methods are accepted.
• Taxes: All applicable taxes, such as GST, are included in the prices or will be added to the invoice.
• Fraudulent Transactions: We reserve the right to recover costs and initiate legal proceedings in case of fraudulent use of the App or transactions.

• App Content: The content on the App, including text, graphics, logos, and images, is the property of or licensed to the company.
• Use Restrictions: Copying, distributing, or using any App content without express written consent is not permitted.

6. User Conduct

• Lawful Use: Users agree to use the App for lawful purposes only and comply with all applicable laws and regulations.
• Prohibited Activities: Prohibited activities include disseminating unlawful content, interfering with other users' enjoyment of the App, or breaching applicable laws.

7. Disclaimers and Limitations of Liability

• Limited Liability: Liability for any damages or losses arising from the use of the App is limited to the extent permitted by law.

8. Governing Law and Dispute Resolution

• Governing Law: These Terms and Conditions are governed by the laws of India, specifically the laws of the State of Andhra Pradesh, subject to the Courts in Visakhapatnam.
• Dispute Resolution: Disputes will be resolved through negotiation, mediation, arbitration, or litigation as outlined in a separate dispute resolution clause or agreement.
